ISLAMABAD, Pakistan: The Supreme Court of Pakistan had not authority to form Terms of Reference (TORs) to form a Commission for Panama investigation, argued a petition filed in the court by Barrister Zafar Ullah Khan on Saturday.
In his petition filed in the SC on Saturday, Barrister Zafar Ullah Khan Challenged the formation of Investigative Commission by Supreme Court to probe Panama leaks, arguing that the apex court had already rejected a government’s plea for formation of proposed Commission.
The petitioner questioned how the Court could interfere in the Parliament’s power as the Parliament was mother of all institutions.
Barrister Zafar Ullah said that that Supreme Court had no authority to form ToRs under which Panama investigation would be carried out.
A five-member bench of Supreme Court headed by Chief Justice of Pakistan Anwar Zaheer Jamali would resume hearing of the Panama Case on Monday in which various parties in the Case would submit their TORs for Panama probe. Pakistan Tehreek-e-Insaf (PTI) has already submitted its TORs.
Prime Minister Nawaz Sharif’s Children including Maryam Nawaz, Hussain Nawaz and Hassan Nawaz would also file their replies regarding the allegations leveled in petitions with reference to Panama Papers.
The Court had already announced that a single-member bench comprising a sitting judge of the Supreme Court and with all the powers of the Supreme Court would investigate Panama Papers.
The petitions were filed by PTI, Jamaat-i-Islami (JI), Awami Muslim League (AML) Chief Sheikh Rashid Ahmed, Barrister Zafar Ullah Khan of Watan Party and Advocate Asad.
Nawaz Sharif though his Counsel Salman Butt and Captain (retd) Safdar have presented their replies before the Court.
