A very rare petition of gender change has been filed in the Peshawar High Court (PHC). This petition has been submitted to the court through Saifullah Mohd Kakakhel Advocate but so far, the court has not set a date for approval or hearing.
This application was filed by a young girl who is reported to be 22 years old. The petition states that the applicant belonged to a poor family. She has two brothers and four sisters and her parents are old.
The application states that the sisters are married, and brothers cannot serve the parents while she is a girl and cannot work in such situations.
The applicant has stated that all her habits are like boys. In addition, she has said that she has the reputation of being a girl, but she considers herself a boy. This application describes some people in developed countries, who say that personal observations of these people suggest that it is very difficult to live as a girl
According to Saifullah Mohib Kakakhel, it has rarely happened in Pakistan that there has been a gender change or gender reassignment surgery. He said that in developed countries, gender change is the individual function and right of every person.
Gender changes can lead to various issues such as changing the box in the ID card, changing the name, changing the educational credentials and changing the NADRA record.
Saifullah Mehboo Kakakhel Advocate said that the Transgender Protection Act has been passed in Pakistan in which anyone has the right to change his gender and the government will provide medical facilities to him.
He further said that under this law, the government would set up rehabilitation centers for such psychiatric patients and would provide them with all the medical facilities that would require them.
Saifullah Mohb Kakakhel said that gender change is not under this law, but it is in the constitution of Pakistan that it is his own way of life.
