ISLAMABAD: The Islamabad High Court (IHC) on Thursday rejected the intra court appeal filed against the special court constituted to try former military ruler General (retd) Pervez Musharraf for high treason.
A two-member bench of the IHC comprising of Chief Justice Anwar Kansi and Justice Shaukat Siddiqui issued its verdict over the intra court appeal.
The petition had been filed by Riaz Hanif Rahi, saying that the formation of the special court was against the Constitution and law. He had demanded of the court to cancel the notification regarding the formation of the special court.
In its judgment, the bench upheld objections of the Registrar Office and rejected the intra court appeal filed against the special court. It said that neither basic rights of the applicant were violated nor he was the affected party in the matter.
The bench further said that the decision to hold Musharraf’s trial was taken by the government and that the person on trial had himself not objected the move.
The Supreme Court of Pakistan had constituted the three-member special court headed by Justice Faisal Arab and comprising Justice Tahira Safdar and Justice Yawar Ali last month in response to a federal government’s request, aiming to try Musharraf under article 6 of the constitution for imposing an emergency in the country on November 3, 2007.
On December 13, the special court held its first meeting in the Federal Shariat Court to examine the complaint filed by the federal government against Musharraf and issued summons to him to appear before it on December 24.
